These Terms of Use (the “Terms”) govern your access to and use of Brainsome.com (the “Site”). The Site is operated by Brainsome Ltd, a company registered in Cyprus (“Brainsome,” “we,” “us,” “our”). By accessing or using the Site, you agree to these Terms.

2. What this Site does (and doesn’t) do

• The Site provides general information about our company and career opportunities.
  
• The Site does not provide financial, legal, or other professional advice. Content is for informational purposes only and may change without notice.
  
• Job descriptions, requirements, and availability are subject to change and may be withdrawn at any time.

3. Eligibility

The Site is intended for users aged 18+. If you are under 18, do not use the Site.

4. Your responsibilities

You agree to use the Site lawfully and not to:

1. violate applicable law;
2. infringe intellectual property or privacy rights;
3. upload, post, or transmit anything unlawful, defamatory, obscene, or harmful (including malware);
4. attempt to gain unauthorised access or test the vulnerability of the Site;
5. engage in scraping, data mining, or automated collection without our prior written consent;
6. interfere with or disrupt the Site or any related networks; or
7. misrepresent your identity or affiliation.

5. Careers and submissions

• You may contact us about roles by emailing hr@brainsome.com or our recruiter on Telegram as instructed in roles descriptions. Do not include sensitive personal data unless requested by us for legal reasons.
  
• By submitting information (e.g., CVs, portfolios, messages) you represent that it is accurate, lawful to share, and does not infringe third‑party rights.
  
• Unsolicited ideas. We do not accept unsolicited product or business ideas. If you still send them, you grant us a worldwide, royalty‑free, irrevocable licence to use them in any manner, and we have no confidentiality obligations for such ideas. This does not apply to your personal data, which we handle under the Privacy Notice.
  
• We may contact you regarding your application, and we may verify information you provide, consistent with law.

6. Privacy

Your use of the Site and any information you submit (including via email or Telegram) is subject to our Privacy Notice. The Privacy Notice explains what data we collect, why, for how long, and your rights.

7. Third‑party services & links

The Site may contain links to third‑party platforms (e.g., Telegram) or content. Those services are not under our control and have their own terms and privacy policies. We are not responsible for third‑party sites or services.

8. Intellectual property

• The Site and its content (text, graphics, logos) are owned by Brainsome or our licensors and are protected by law.
  
• We grant you a limited, non‑exclusive, non‑transferable licence to access and use the Site for your personal, non‑commercial use, subject to these Terms.
  
• You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Site or its content, except as permitted by mandatory law.

9. Availability and changes

• The Site is provided on an “as is” and “as available” basis. We do not guarantee it will be uninterrupted or error‑free.
  
• We may suspend, withdraw, or change all or any part of the Site without notice (e.g., for maintenance or security).
  
• We may update these Terms at any time by posting a revised version with a new “Last updated” date. Your continued use constitutes acceptance of the updated Terms.

10. No warranties

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non‑infringement, with respect to the Site and its content.

11. Limitation of liability

• Nothing in these Terms excludes or limits liability where it would be unlawful to do so (e.g., for death or personal injury caused by negligence, or for fraud).
  
• Subject to the above, Brainsome and its officers, employees, and agents shall not be liable for any: (a) loss of profits, revenue, business, goodwill, or data; (b) indirect or consequential loss; or (c) loss arising from your use or inability to use the Site, reliance on content, or any third‑party sites/services.
  
• If we are found liable despite the foregoing, our total aggregate liability arising out of or related to the Site will be limited to EUR 100.

12. Security

We implement measures appropriate to the risk to keep the Site secure. However, the internet is not 100% secure; you should take your own precautions (e.g., use up‑to‑date antivirus and avoid sending sensitive data unless requested and secured).

13. Electronic communications

When you contact us by email or via the Site, you consent to receive communications from us electronically, and you agree that such communications satisfy any legal requirement that they be in writing (to the extent permitted by law).

14. Governing law and jurisdiction

These Terms and any non‑contractual obligations arising out of or in connection with them are governed by the laws of Cyprus. The courts of Cyprus shall have exclusive jurisdiction, except that we may seek injunctive relief in any competent court to protect our intellectual property or confidential information.

15. Severability; no waiver

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right is not a waiver of it.

16. Entire agreement;

These Terms constitute the entire agreement between you and us regarding the Site and supersede prior terms on this subject.
